29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average (TWA) of 85 decibels: On or about March 31, 2021, and at times prior thereto, where the employer did not provide audiometric testing to employees exposed to continuous noise exceeding the daily action level TWA of 85 dBA while working the facility: (a) in the Trim area: Employees were exposed to continuous noise at 135.8% of the permissible daily noise exposure (8-hour Time Weighted Average of 85 dBA during the 445 minute sampling period and were not included in the hearing conservation program. For a full eight hour work shift this exposure is equivalent to an average noise exposure level of 92.2 dBA. Exposure calculations include a zero increment for the 35 minutes not sampled. (b) in the Mold Shop: Employees working in the area were exposed to continuous noise at 100.4 % of the permissible daily exposure limit (8-hour Time Weighted Average sound level of 85 dBA) during the 448 minute sampling period and were not included in the hearing conservation program. For a full eight hour work shift this exposure is equivalent to an average noise exposure level 90.0 dBA. Exposure calculations include a zero increment for the 32 minutes not sampled. (c) in the Solid Surface: Employees working in the area were exposed to continuous noise at 70.7% of the permissible daily exposure limit (8-hour Time Weighted Average sound level of 85dBA) during the 447 minute sampling period and were not included in the hearing conservation program. For a full eight hour work shift this exposure is equivalent to an average noise exposure level of 87.5 dBA Exposure calculations include a zero increment for the 33 minutes not sampled. Clarke Products Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(g)(1), which was contained in OSHA inspection number 1311129, citation number 001, item number 002-a, issued on October 1, 2018, and was affirmed as a final order on October 24, 2018, with respect to a workplace located at 2100 B Orchard Lane, Waco, Texas 76705.
