29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On or about September 11, 2020, and at times prior to and thereafter, at excavation sites located at the intersection of 91st and Aspen in Broken Arrow, OK, the employer allowed employees to work in an excavation without protective head gear/hardhats, exposing employees to the hazard of being struck by falling objects. Cherokee Pride, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.100(a), which was contained in OSHA inspection number 1206000, citation number 1, item number 1a, and was affirmed as a final order on May 22, 2017, with a final abatement date of April 13, 2017, with respect to a workplace hazard at W. 81st Street and 23rd West Ave. Tulsa, OK 73132. Cherokee Pride, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.100(a), which was contained in OSHA inspection number 1242458, citation number 2, item number 1, and was affirmed as a final order on November 28, 2017, with a final abatement date of November 3, 2017, with respect to a workplace hazard at 9854 S. 49th West Ave. Sapulpa, OK 74066.
