29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in subpart M: (a)Grangaard Construction, Inc. at Highway 212 Bridge site, Watertown, SD 57201: On or about and at times prior to October 19, 2019, the employer did not ensure each employee who is exposed to fall hazards had been trained by a competent person, in that employees were walking/working on horizontally placed I-beams within a cofferdam without the use of a fall protection system. This condition exposed employees to a fall of approximately 20 feet. Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph 1926.503(a) by preparing a written certification record, which shall contain the name of the person being trained, the dates of training, and the signature of the person who conducted the training, or the signature of the employer. If the employer relies on training conducted by another employer, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of the actual training. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: a) The nature of fall hazards in the work area; b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; d) The role of each employee in the safety monitoring system when this system is used; e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g) The role of employees in fall protection plans; h) The standards contained in this subpart. Grangaard Construction, Inc. was previously cited for violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.503(a)(2), which was contained in OSHA inspection number 1268591, citation number 1, item number 2b, and was affirmed as a final order on February 13, 2018, with respect to a workplace located at Exit 98 I-29 & SD Hwy 115 in Dell Rapids, SD 57022.
