29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. a. The employer has failed to submit abatement certification and documentation within ten days of the abatement date, April 26, 2019, for a violation of 29 CFR 1926.501(b)(13), issued as citation 1, item 1, and described as follows: 29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. The employer does not protect each employee from the hazard of falling by the use of fall protection systems. This most recently occurred on March 13, 2019, at the residential site located at 7336 Connor Avenue in Canal Winchester, Ohio. The employer failed to ensure employees performing framing work onsite were protected from falls while sheathing roof trusses and working at unprotected window openings. Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in inspection number: 1) 1301052, Citation 1, Item 4, Issued on 03/29/2018 Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards. b. The employer has failed to submit abatement certification and documentation within ten days of the abatement date, April 26, 2019, for a violation of 29 CFR 1926.20(b)(1), issued as citation 2, item 1, and described as follows: 29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. Located at the residential site located at 7336 Connor Avenue in Canal Winchester, Ohio: On or about March 13, 2019, the employer failed to maintain a safety and health program for employees performing framing work to ensure hazards were identified and corrected onsite. The employer has failed to submit abatement certification and documentation within ten days of the abatement date, April 26, 2019, for a violation of 29 CFR 1926.21(b)(2), issued as citation 2, item 2a, and described as follows: 29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. Located at the residential site located at 7336 Connor Avenue in Canal Winchester, Ohio: On or about March 13, 2019, the employer failed to provide training for employees on safety and health hazards in construction. Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1301052, citation number 1, item number 2a, and was affirmed as final order on April 24, 2018, with respect to a workplace at 42 West Columbus Street, Lithopolis, OH, 43136. d. The employer has failed to submit abatement certification and documentation within ten days of the abatement date, April 26, 2019, for a violation of 29 CFR 1926.503(a)(1), issued as citation 2, item 2b, and described as follows: 29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a. Located at the residential site located at 7336 Connor Avenue in Canal Winchester, Ohio: On or about March 13, 2019, the employer failed to provide fall protection training for employees performing framing work onsite. The employer has failed to submit abatement certification and documentation within ten days of the abatement date, April 26, 2019, for a violation of 29 CFR 1926.102(a)(1), issued as citation 2, item 3, and described as follows: 29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a. Located at the residential site located at 7336 Connor Avenue in Canal Winchester, Ohio: On or about March 13, 2019, the employer failed to ensure employees operating the air nailer and circular saw were using eye protection, thereby exposing employees to a struck-by hazard.
