29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization. On or about Friday, January 04, 2019 at 5:30 p.m. a temporary employee acting in the capacity of warehouse associated was backing a stand-up forklift toward a battery charging station when the employee placed his foot down behind the forklift in an attempt to slow down and the employees foot was caught between the forklift and a battery charger resulting in the in-patient hospitalization of the employee who required surgery. The incident was reported to OSHA on Monday, January 07 at 9:30 a.m. by the temporary staffing agency that provided the employee to the host employer.
