29 CFR 1926.1053(b)(1): The employer does not ensure that where portable ladders are used for access to an upper landing surface and the ladder's length allows, the ladder side rails extend at least 3 feet (.9 m) above the upper landing surface being accessed. 157 Congress Street - The ladder being used to access the ladder jack scaffolding did not extend at least three feet past the planking for access. The employer fails to assure effective protections against fall hazards as required by the standard, as demonstrated on December 13, 2018, when employees were exposed to a ladder not extending three feet above the landing of the scaffolding to allow for safe transition onto the scaffolding. Purvis Home Improvement, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1046978, citation number 1, item number 1 and was affirmed as a final order on 04/13/2015, with respect to a workplace located at Avenue 3, Pine Point Maine 04074.
