29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. Employees are exposed to a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns while engaged in construction activities. The employer does not protect each employee by means of a protective helmet. On or about November 3, 2016, employees performing framing operations on a residential property were exposed to struck by hazards while handing material and tools to the second level from the ground level. Employees were not wearing hard hats and the employer failed to mandate the use of head protection. The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1067171, citation number 1, item number 1 and was affirmed as a final order on October 29, 2016, with respect to a workplace located at 3704 Heathmoor Drive, Elgin, Illinois. To abate this hazard in the future, the employer must ensure that its employees performing residential construction activities are protected from the danger of head injury from impact or falling or flying objects and that no employee is exposed to possible danger without a protective helmet. Abatement documentation required for this item in accordance with 29 CFR 1903.19(d).
