OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees drop-start chainsaws in preparation of cutting logs to size and cutting boards to length: (a) Mill Area: On or about March 9, 2016 and times prior, chainsaws such as the Stihl MS362 with 24" bar, Stihl Super 029 with 24" bar, and Stihl MS290 with 18" bar, were drop-started prior to cutting logs and boards to specified lengths. Wayne Lumber and Mulch, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, General Duty for drop starting chainsaws, which was contained in OSHA inspection number 961178, citation number 1, item number 20 and was affirmed as a final order on September 25, 2014, with respect to a workplace located in Wayne, WV.
