29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. a) MTD Consumer Group Inc., 979 South Conwell Avenue Willard, OH: On or about October 14, 2015, the employer did not evaluate the respiratory hazards in the work place. Employees working at MTD Consumer Group Inc. were exposed to acetone vapors from touch up spray painting operations that were being conducted. The employer failed to conduct previous monitoring for employee exposure to the hazard.
