Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of feet or hands being caught between the freight/storage elevator and the shaft causing them to be fractured or amputated. This elevator is located at the Pearl Street side of the building. One feasible and accepted abatement method, among others, is to activate the safety devices and to instruct and train employees that the safety devices shall not be by-passed.
