Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees in and around the resin building (buildings 28 and 28A) including Shipping/Receiving Employee #3 were exposed on and before July 19, 1990, to the increased hazards of fire and explosion due to the release of flammable materials (including PX solvent vapors) from the kettles in that: See descriptive paragraph in item 1 above (incorporated by reference)
