Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and smoke: %% (a) Mc Crory Store #363, Huntington Station, N.Y.; Employee number 58 did not receive training on how to evacuate or escape from the store in a fire or other emergency not was the employee afforded an opportunity to participate in fire drills; on or about May 12, 1991, through May 16, 1991. %% Among other methods, one feasible method to eliminate or to materially reduce this hazard is to enforce the pre existing Mc CroryCorporation plan contained in the McCrory Operations Manual, (Volume II, Section 2014), Emergency Precautions", which includes the requirements for both employee training in evacuation procedures and their participation in fire drills. %%
