29 CFR 1926.1101(g)(1)(i): The employer did not use engineering controls and work practices in all operations covered by 29 CFR 1926.1101, regardless of the levels of exposure, in the form of vacuum cleaners equipped with high efficiency particulate air (HEPA) filters to collect all debris and dust containing asbestos containing material and presumed asbestos containing material: a) Olivet Management LLC does not protect its employees and subcontractors' employees from the hazard of exposure to asbestos by not using engineering controls and work practices in all operations covered by 1926.1101 regardless of the levels of exposure, in the form of vacuum cleaners equipped with high efficiency particulate air (HEPA) filters to collect all debris and dust containing asbestos containing material and presumed asbestos containing material. On or about October 4-25, 2013, at the Harlem Valley Psychiatric Center worksite, employees disturbed, removed, and swept up debris from asbestos-containing tile, carpet with asbestos-containing mastic, and thermal systems insulation, inside buildings including but not limited to Buildings 3, 11, 12, 14, 17, 29, 30, 31, 32, 35, 85, and 107.
