29 CFR 1926.1101(k)(9)(i): The employer did not institute, at no cost to employees, a training program for each employee who was likely to be exposed in excess of the permissible exposure limit (PEL) and for each employee who performed Class I through IV asbestos operations: a) Olivet Management LLC does not protect its subcontractors' employees from the hazard of exposure to asbestos by not instituting, at no cost to employees, a training program for each employee who was likely to be exposed in excess of the permissible exposure limit (PEL) and for each employee who performed Class I through IV asbestos operations. On or about October 4-25, 2013, at the Harlem Valley Psychiatric Center worksite, employees disturbed, removed, and swept up debris from asbestos-containing tile, carpet with asbestos-containing mastic, and thermal systems insulation, inside buildings including but not limited to Buildings 3, 11, 12, 14, 17, 29, 30, 31, 32, 35, 85, and 107.
