Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Employees were exposed to falling into the tank due to the roof's structural deficiencies at Unit #1 Tar Tank Storage Area #1 Separator Tank. The roof plates were extremely flexible under foor with localized areas of rust pitting and rust layering. A feasible and useful method of abatement, among other methods is to repair the tank to a safe structural condition.
