29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Guelsin Lima dba Extreme Roofing and Siding LLC does not ensure that employees use appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about 07/07/2022, at 43-48 Hearthstone Court, Upper Saddle River, NJ/Roof. The employee #2 was engaged in installation of roofing materials on a 6 on 12 pitch roof was not protected from fall hazards of approximately 30 ft to the asphalt below. The employee wore an inadequate personal fall arrest harness and was not using a lanyard, anchor point, or a lifeline. Pursuant to 29 CFR 1903.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of the type of head protection provided and the steps taken to enforce use of appropriate fall protection where employees are exposed to possible danger of fall hazards.
