29 CFR 1910.178(c)(2)(vi)(a): The employer did not provide powered industrial trucks designated as EX for use in an atmosphere in which combustible dust is or may be in suspension continuously, intermittently, or periodically under normal operating conditions, in quantities sufficient to produce explosive or ignitable mixtures, or where mechanical failure or abnormal operation of machinery or equipment might cause such mixtures to be produced. a) Spice Chain Corporation/East Brunswick, NJ - Milling Area: On or about October 24, 2019 the employer did not ensure that forklifts designated as EX were used in an atmosphere in which Class II combustible powder was present. Employees operated powered industrial trucks such as, but not limited to Yale (SN: A969N01608J, classified as E), and Toyota (SN: 60299, classified as E), etc., in an atmosphere in which Class II combustible powdered spices such as cumin, cinnamon and paprika were used; Exposing employees to explosion and fire hazards.
