29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) Jobsite - The employer does not require employees to use any form of personal fall arrest systems or the use of guardrail systems while performing bricklaying operations from a fabricated frame scaffold. This violation was most recently observed at the property 827 North 26th Street, Philadelphia, Pennsylvania 19130 on or about 20 MARCH 2017 where employees were performing bricklaying operations above the second level of the fabricated frame scaffold and were not protected from fall hazards of approximately eighteen (18) feet by the use of personal fall arrest systems or guardrail systems. To abate this ongoing violation, the employer must provide and require the use of personal fall arrest systems or guardrail systems while employees are utilizing the working levels of the scaffold. Vyacheslav Leshko dba T&S Masonry, LLC. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 963773, citation number 1, item number 2a and was affirmed as a final order on 24 APRIL 2014 with respect to a workplace located at 1532 Manton Street, Philadelphia, PA 19146. Vyacheslav Leshko dba T&S Masonry, LLC. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 975468, citation number 2, item number 4 and was affirmed as a final order on 21 NOV 2014, with respect to a workplace located at Kimball Street and S. 23rd Street Philadelphia, PA 19146. Vyacheslav Leshko dba T&S Masonry, LLC. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 982139, citation number 2, item number 4 and was affirmed as a final order on 21 NOV 2014 with respect to a workplace located at 1024 South 19th Street Philadelphia, PA 19146.
