29 CFR 1910.146(k)(3)(ii): To facilitate non entry rescue, retrieval systems attached to a mechanical device or fixed point outside the permit space in such a manner that rescue can begin as soon as the rescuer becomes aware that rescue is necessary. A mechanical device shall be available to retrieve personnel from vertical type permit spaces more than 5 feet (1.52 m) deep: a. On or about July 28, 2014, employees were required to enter permit required confined spaces. The entrant employees were not provided with reliable working mechanical lifting device(s) in both bay 1 and 2 for use in the assistance of a non entry rescue, thereby exposing employees to the hazards associated with permit required confined spaces. 1. Bay 1 had a rusted trolley and a mechanical lifting device which would not retract in the event of an emergency. 2. Bay 2 did not have a mechanical lifting device in place. The Dedicated TCS, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.146(k)(3)(ii),which was contained in OSHA inspection number 415682, citation number 2, item number 2 and was affirmed as a final order on November 20, 2012, with respect to a workplace located at 17356 Torrence Avenue, Lansing, IL 60438. The Dedicated TCS, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.146(k)(3)(ii), which was contained in OSHA inspection number 388589, citation number 1, item number 7 and was affirmed as a final order on March 11, 2013, with respect to a workplace located at 23330 South Frontage Road W, Channahon, IL 60410.
