29 CFR 1926.451(h)(2)(ii):A toe board was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below: On or about May 31, 2023, employees conducting plastering activities on a residential construction site were observed working on a scaffold platform without toe boards. This condition exposed employees to struck-by hazards. Victor Olvera was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.451(b)(1), which was contained in OSHA inspection number 1634256, citation number 2 item number 5 and was affirmed as a final order on February 10, 2023, with respect to a workplace located at 10632 Hidden Chapel El Paso, TX 79924.
