Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Employees were exposed to being struck by metal parts and tank contents due to breach of containment at #4 Ammonia Storage Tank (Weak Liquor) - 2nd Unit. The tank was in deteriorated condition. Over 50 percent of the roof plate has rusted away or fallen into the tank. The roof rafter system has deteriorated to the point that collapse appears imminent. The ring angle at the top has rusted away. Areas of the shell plate are rust packed or gouged to 3/16 inch depth. Rivet heads in many horizontal and vertical seams are 60 percent to 90 percent deteriorated. Rivet heads on the west side at the bottom of the first plate are almost nonexistent. The tank bottom plate has rusted away at the drain pit at the west side. Among other methods, one feasible method of abatement is to remove from service, dismantle and scrap the tank.
