29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) On or about September 19, 2024, at a jobsite located at 3747 E Bluestem Dr., Oak Creek, WI 53154, the portable ladder being used by employees to access the roof of the structure at or near the garage door did not extend at least three (3) feet above the upper point of contact with the eave, nor was it secured in place. This exposed employees accessing and egressing the roof, to a fall hazard of approximately 11.3 feet onto grass, building materials, and concrete. Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1678064, citation number 2, item number 3 and was affirmed as a final order on December 12, 2023, with respect to a workplace located at 851 South Wilson Street, Hartford, WI 53027.
