29 CFR 1926.1053(b)(1): Where portable ladders are used for access to upper landing surfaces, the ladder side rails do not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders are used to gain access, and where such extension is not possible because of the ladder's length, the employer fails to secure the ladder at its top to a rigid surface that will not deflect, and provide a grasping device to assist employees in mounting and dismounting the ladder. a-ALJ Home Improvement Inc does not ensure that when it uses a portable ladder for access to upper landing surfaces, that the side rails extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access, and when such extension is not possible because of the ladder's length, fails to secure the ladder at its top to a rigid surface that will not deflect, and provide a grasping device to assist employees in mounting and dismounting the ladder. This violation was most recently observed, on or about August 4, 2022, at 514 Warren Ave, Ho-Ho-Kus NJ 07423: Employees engaged in roofing activities were using a Werner extension ladder to access a roof and were exposed to fall hazards of approximately 12ft to the asphalt below in which the ladder side rails did not extend 3 feet (.9 m) above the upper landing surface and the employer did not secure the ladder at its top to a rigid surface that will not deflect, and provide a grasping device to assist employees in mounting and dismounting the ladder. Pursuant to 29 CFR 1903.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including an abatement plan and the steps taken to enforce compliant use of portable ladders
