29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) Estate Custom, LLC located at or near 3451 Northup Ave, South Bloomfield, OH 43103: On and preceding December 14, 2021, the employer did not ensure that protection was provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of trench. An employee was performing water and storm plumbing installation in an excavation that was 18-20 feet deep working within a single 8' tall trench shield with the excavated materials on the west and southwest end of the trench were pile 2' high on the edge of these sections. The following condition exposed employees to struck-by/caught-in hazards. Estate Custom, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 1471742 , citation number 1, item number 4 and was affirmed as a final order on June 22, 2020, with respect to a workplace located at Scioto Landing development, SOUTH BLOOMFIELD, OH 43103.
