29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer does not protect each employee from fall hazards while accessing and or egressing from elevated working surfaces via portable ladders. The employer provides portable ladders and equipment to performing roofing activities on residential homes and or structures with elevated working surfaces at heights of approximately 10.1 feet above the ground and continuously allows the portable ladders not to extend 3 feet above the upper landing surfaces. This most recently occurred on or about March 5, 2020 at the job site located at 7947 Chatham Ave NW, N. Canton, Ohio 44720; during the installation of roofing material on a residential roof, the employer did not ensure portable ladders were extended 3 feet above the upper landing surface.
