29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (c). The employer is failing to protect employees from struck-by and engulfment hazards associated with trenching and excavation. This was most recently documented on or about 05/29/2019, at jobsite located at 2600 block of NE 46th St, KC MO. The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in excavations were protected from engulfment hazards. The trench was greater than 5 feet in depth. Blue Nile Contractors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1109361, citation number 1, item number 2 and was affirmed as a final order on 01/06/2016, with respect to a workplace located at 8529 N Highland, KC MO, and OSHA inspection number 1341476, citation number 2, item number 1, and was affirmed final order on 11/05/2018, with respect to workplace located at 202 Winn Rd, KC MO.
