29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years. On or about 14 February 2018, the employer failed to conduct periodic (refresher) powered industrial truck operator training, at least every three years. This exposed employees to a struck-by hazard likely to cause fracture(s). Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
