29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about March 10, 2017 at 2910 North Druid Hills Roads, Atlanta, Georgia: an employee working in a unprotected trench was exposed to a cave in hazard when the spoil pile was placed on the edge of the trench. The sidewalk, parking lot, and spoil pile were not supported or placed in a position so that it did not create a hazard to the employee working in the trench.
