29 CFR 1926.1101(e)(1): All Class I, II and III asbestos work shall be conducted within regulated areas. All other operations covered by this standard shall be conducted within a regulated area where airborne concentrations of asbestos exceed, or there is a reasonable possibility they may exceed a PEL. Regulated areas shall comply with the requirements of paragraphs (2), (3),(4) and (5) of this section. Workers were engaged in residential construction activities removing existing roofing material that contained 15% Chrysotile asbestos. The employer did not set up a regulated area for employees removing roofing material containing 15% Chrysotile asbestos. The P-1 Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 315496877, citation number, 01 item number 001 and was affirmed as a final order on October 6, 2011, with respect to a workplace located at 124 E. 7th Street, Cincinnati, OH 45202.
