29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) The employer does not require employees to use any form of personal fall arrest systems or the use of guardrail systems while performing stucco operations from a fabricated frame scaffold. This violation was most recently observed at the property 3018 West Thompson Street, Philadelphia, PA 19121 on November 3, 2015, where employees performing stucco operations were exposed to fall hazards of approximately thirty-nine (39) feet without the use of personal fall arrest systems or guardrail systems. To abate this ongoing violation, the employer must provide and require the use of personal fall arrest systems or guardrail systems while employees are utilizing the working levels of the scaffold. Penn Stucco, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(vii), which was contained in OSHA inspection number 995057, citation number 1, item number 6a and was affirmed as a final order on January 7, 2015, with respect to a workplace located at 624-626 Flora Street, Philadelphia, PA 19125. Penn Stucco, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(vii), which was contained in OSHA inspection number 939267, citation number 2, item number 4 and was affirmed as a final order on November 8, 2013, with respect to a workplace located at 840-842 Christian Street, Philadelphia, PA 19147.
