29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: (a) Jobsite located at 3515 Midvale Avenue Philadelphia, PA, 19129: The employer did not ensure the excavation, approximately 11.5 feet deep was benched in accordance with the requirements set forth in Appendix A and B of the standard exposing employees conducting footings activities to soil collapse hazards. Condition noted on or about August 27, 2021. Real Construction, Inc. was previously cited for a willful violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1) which was contained in OSHA inspection number 1348513, citation number 2, item number 1, and was affirmed as a final order on March 30, 2020, with respect to a workplace located at 2010 Walnut Street, Philadelphia PA 19102.
