29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Jobsite located at 3515 Midvale Avenue Philadelphia, PA, 19129: The employer did not ensure that employees working in an excavation, approximately 11.5 feet deep were protected from soil collapse hazards by the use of an adequate protective system, including but not limited to proper benching in accordance with the requirements set forth in Appendix A and B of the standard. Condition noted on or about August 27, 2021. Real Construction, Inc. was previously cited for a willful violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1) which was contained in OSHA inspection number 1348513, citation number 2, item number 1, and was affirmed as a final order on March 30, 2020, with respect to a workplace located at 2010 Walnut Street, Philadelphia PA 19102.
