29 CFR 1926.1053(b)(1): When portable ladders had been for access to an upper landing surface, the ladder side rails had not extended at least 3 feet (.9 m) above the upper landing surface to which the ladder had been used to gain access; or, when such an extension had not been possible because of the ladder's length, then the ladder had not been secured at its top to a rigid support that would not deflect, and a grasping device, such as a grabrail, had not been provided to assist employees in mounting and dismounting the ladder. On or about October 2, 2024, California Exteriors LLC did not ensure that a portable ladder used to access the roof of a three-story apartment building at 1131 O'Fallon Lakes Drive in O'Fallon, Missouri, was properly positioned. The ladder's extension was not possible because of the ladder's length, and the employer did not provide a grasping device to assist employees in mounting and dismounting the ladder, thus exposing four employees to fall hazards. REPEAT Rafael Ortiz DBA Cardinal Exteriors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1708110, citation number 1, item number 2 and was affirmed as a final order on April 4, 2024, with respect to a workplace located at 140 Venita Drive in O'Fallon, Illinois. Rafael Ortiz DBA Cardinal Exteriors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1688182, citation number 1, item number 4 and was affirmed as a final order on August 11, 2023, with respect to a workplace located at 13 J C Drive in Swansea, Illinois.
