Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer failed to have performed by an authorized person or firm periodic inspection testing and maintenance as prescribed by the B.O.C.A. Natural Building Code/1987 (which incorporates ANSI A17.1-1971 by reference) as adopted by the enforcing authority, the city of Wilmington, Deleware: a) Warehouse - freight elevator serving five (5) floors plus the basement; 10-18-89 AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORREC THIS HAZARD IS TO PERFORM PERIODIC INSPECTION TESTING AND MAINTENANCE PROCEDURES IN ACCORDANCE WITH THE B.O.C.A. NATIONAL BUILDING CODE/1987.
