29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about May 1, 2024 the employer MDM & Sons Construction, LLC at jobsite located at 1003 Brampton Park Rd. (Lot 81) Perrysburg OH 43551, does not ensure employees are protected from falls while conducting residential framing construction activities on the second (roof) level of a residential single family home, while exposed to fall hazards of approximately 12 feet and 13 feet or greater to the ground below. This violation was most recently observed on or about May 1, 2024 at the address of 1003 Brampton Park Road, Perrysburg, OH 43551. To abate this citation, the employer must demonstrate that fall protection is provided and being used by its employees when working more than 6 feet from the lower level.
