29 CFR 1910.1053(e)(1): Regulated areas-(1) Establishment. The employer shall establish a regulated area wherever an employee's exposure to airborne concentrations of respirable crystalline silica is, or can reasonably be expected to be, in excess of the PEL. The employer failed to establish and implement regulated areas for employees with exposure that exceeded the respirable crystalline silica PEL for the following documented employee exposures: a. On or about November 1, 2023, an employee was exposed to airborne respirable crystalline silica that exceeded the PEL while performing Forklift Operator duties in the Shakeout area. The employee was exposed to a concentration of 72.1 ?g/m3 as an 8-hour time weighted average during the 474 minute sampling period which was approximately 1.44 times the PEL. Zero exposure was assumed for the six minutes not sampled. Liberty Casting Company, LLC. was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1910.1053(e)(1), which was contained in OSHA inspection number 1390789, citation number 1, item number 14 and was affirmed as a final order on October 17, 2019, with respect to a workplace located at 550 Liberty Rd, Delaware, OH 43015.
