29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access: a) 15 Sutton Drive, Dover, DE 19901: On or about May 19, 2023, employees used ladders that did not extend at least 3 feet above the upper landing to access the upper levels of a roof, approximately 11 feet above the ground, exposing them to falls. The Marin Cruz Samuel d/b/a Samuel Marin Cruz, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1576054, citation number 1, item number 4 and was affirmed as a final order on August 8, 2022, with respect to a workplace located at 7175 Burnite Mill Road, Felton, DE 19943.
