29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system. a-ALJ Home Improvement Inc does not ensure that employees use appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about 08/04/2022, at 514 Warren Ave, Ho-Ho-Kus, NJ/Roof. Employee #3 was engaged in the removal of roofing shingles on a rear 6 on 12 roof pitch and was not protected from fall hazards of approximately 18 ft to the asphalt below. Pursuant to 29 CFR 1903.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of the type of fall protection provided and the steps taken to enforce use of appropriate fall protection where employees are exposed to possible danger of fall hazards.
