29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): At the Trenching and Excavation site located in the 300 block of E. Ford St, in Valley Center, Sedgwick County, KS, employee(s) engaged in trenching and excavation activities were exposed to cave in hazards in that employee(s) were inside a trench approximately 8 feet in depth without the use of an adequate protective system. The trench was benched, but not in accordance with the proper ratio of 3/4:1 for Type B soil. Dutton Construction & Plumbing, LLC., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1241502, citation number 2, item number 1, and was affirmed as a final order on December 26, 2018, with respect to a workplace located on the south side of the road on Rock Road, in Derby, KS.
