29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. The employer does not protect each employee from fall hazards while accessing and or egressing on residential structures with unprotected sides and edges at height of approximately 9.4 feet above the ground by ensuring that portable ladders are extended 3 feet above the upper landing surface or having a grasping device, such as a grab rail to assist employees in mounting and dismounting the ladder. This most recently occurred on December 2, 2021 at the job site located at 4694 Wyoga Lake Rd, Stow, Ohio 44224; during the installation of roofing material on a residential roof, the employer did not ensure portable ladders extended 3 feet above the upper landing surface and or have a grab rail to assist in the mounting and or dismounting of the portable ladder. To abate this hazard in the future, the employer must ensure employees who utilize ladders for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps they are taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards. ILS Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.1053(b)(1) Portable Ladders), which was contained in OSHA inspection number 1501432, citation number 01, item number 01 and was affirmed as a final order on 3/23/2021, with respect to a workplace located at 173 Applegrove St NE, Canton, OH 44720.
