29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). The employer is failing to protect employees from struck-by and collapse hazards associated with trench work. This was most recently documented at the residential construction site located at the corner of SW Valley Drive and SW Meadowood Drive, Grain Valley, Missouri, on October 14, 2021, (a) On or about 11:43 a.m., when employee number 1 entered and worked in an excavation that was over five feet deep and was not protected with an adequate protective system. (b) On or about 11:55 am., employee number 2 entered and worked in an excavation that was over five feet deep and was not protected with an adequate protective system. This entry occurred after employee number 1 exited the excavation.
