29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Agners Framing Construction LLC., at a jobsite located at 161 Crimson Drive, Lot 13478, Newark, Ohio 43055: On and/or preceding May 18, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing the second story. The employee did not have any means of fall protection, thereby exposed to fall hazards of up to 19 feet, 5 inches. b) Agners Framing Construction LLC., at a jobsite located at 161 Crimson Drive, Lot 13478, Newark, Ohio 43055: On and/or preceding May 18, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees used the first floor to access the second story where the basement opening was unguarded, thereby exposed to fall hazards of up to 10 feet. c) Agners Framing Construction LLC., at a jobsite located at 161 Crimson Drive, Lot 13478, Newark, Ohio 43055: On and/or preceding May 18, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees accessed the second story where the first story wall openings were unguarded, thereby exposed to fall hazards of up to 10 feet, 11 inches. Agners Framing Construction LLC. AKA Rojas Construction, was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1385399, citation number 1, item number 1c and was affirmed as a final order on May 7, 2019, with respect to a workplace located at 6729 North Hamilton Road, building #5, Westerville, OH 43081.
