29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means were taken to assure safe operation: CP-2 and CP-4 Engine Rooms: On or about October 20, 2020, the employer failed to correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means were taken to assure safe operation for the following instances: a) CP-2-14 - K12791 valves have not been properly exercised and lubricated at least every 5 years. b) CP-2-92 - V15789 piping has burn marks outside of CP-2. Two piping spots by V15789-HV09 and V15789-HV07 were not painted to address the corrosion. c) CP-4-47 - P14821-HV03 ammonia pump has ice accumulation outside of CP-4 by the Accumulator, Main Pumped Liquid Valve. Employer failed to remove ice periodically to prevent excessive ice buildup. d) CP-4-47 - P14822-HV03 ammonia pump has ice accumulation outside of CP-4 by the Accumulator, Main Pumped Liquid Valve. e) CP-4-47 - P14823-HV03 ammonia pump has ice accumulation outside of CP-4 by the Accumulator, Main Pumped Liquid Valve. f) CP-4-47 - P14824-HV03 ammonia pump has ice accumulation outside of CP-4 by the Accumulator, Main Pumped Liquid Valve. Employees engaged in operating, inspecting, testing, and maintaining activities at the covered process equipment in the CP-2 and CP-4 engine rooms were exposed to catastrophic release of ammonia which results in asphyxiation, explosion and flash fire leading to death and injury to persons in and near the facility in that employees are allowed to operate the plant with deficiencies process covered equipment. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete. The Schwan's Global Supply Chain Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1910.119(j)(5), which was contained in OSHA inspection number 1386295, citation number 1, item number 3 and was affirmed as a final order on 6/11/2019, with respect to a workplace located at 2900 Rolling Pin Lane Suite A Suwanee, GA 30024.
