29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a) Kinzua Water Treatment, Inc. dba Culligan Water, Water treatment area, on or about June 26th, 2020 and times prior thereto: Some employees voluntarily used air purifying half mask respirators (3M brand 6300 series with organic vapor/P100 cartridges) during work tasks including, but not limited to, hand pumping operations of muriatic acid and caustic soda acid. The company did not establish portions of a respiratory protection program that covered medical evaluations and respirator maintenance and care. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
