29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. The employer does not protect each employee from struck-by hazards by the use of appropriate eye or face protection. This most recently occurred on February 3, 2020 on the job site located at Lot 1271, 11988 Warbler Way, Plain City, Ohio, 43064. The employer failed to ensure that employees who were performing framing work while using pneumatic nail guns and circular saws were protected from struck-by hazards. Martin Venegas was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1296904, citation number 1, item number 2 and was affirmed as a final order on May 1, 2018, with respect to a workplace located at 6224 Central College Road, New Albany, OH 43054.
