29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Route 873, Slatington - The employer does not ensure that portable extension ladders are being used properly. A specific instance of this continuing violation was most recently observed on or about June 11, 2018, when employees were performing residential roofing activities using an extension ladder that was not extended at least three feet above the upper landing surface. Alternatively, the ladder was not secure, nor had grasping devices available for the employee's use. The employer's ongoing obligation is to ensure that portable ladders are set for the proper working length.
