29 CFR 1910.178(p)(1): Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s): a) Yard - The Drott straddlelift/travelift crane, Serial Number 69A216237 Co. # TL2, did not have operable travel brakes, no audible alarm, no fenders or bumpers on the wheels, the horn does not work, the windows in the door and side are broken, the seat is falling apart, no signal chart is on the machine, and the company does not have an inspection program. b) Yard - The Mi-Jack travelift, Serial Number 6209589, Co. # TL4, did not have properly working travel brakes, no inspection program, stress cracks in the left rear column, no signal chart, loose bolt in the right column and the windshield was cracked. While traveling in the main building, the operators view was obstructed by the ledger beam form. The form is one hundred sixty (160) feet long and eighty six (86) inches high. A spotter was not used, the travel alarm and horn did not work and the fender and bumpers around the wheels were removed, exposing the employee(s) to a serious hazard. OR IN THE ALTERNATIVE Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a) Yard - The Drott straddlelift/travelift crane, Serial Number 69A216237 Co. # TL2, did not have operable travel brakes, no audible alarm, no fenders or bumpers on the wheels, the horn does not work, the windows in the door and side are broken, the seat is falling apart, no signal chart is on the machine, and the company does not have an inspection program. b) Yard - The Mi-Jack travelift, Serial Number 6209589, Co. # TL4, did not have properly working travel brakes, no inspection program, stress cracks in the left rear column, no signal chart, loose bolt in the right column and the windshield was cracked. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the manufacture's recommendations contained in the operators manual that the Maintenance Department has.
