29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: Each employee engaged in sheathing activities is exposed to fall hazards from using portable ladders with structural defects, such as but not limited to, broken rungs, missing feet, etc. New Homes Construction, Inc. does not ensure the use of portable ladders without structural defects while performing sheathing and other related activities at the worksite. This violation was most recently observed at Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ where employees were exposed to fall hazards when utilizing two separate aluminum extension ladders that were both missing their factory supplied feet, contained visibly damaged rungs, etc. This condition was noted on or about 10/06/16. To abate this violation the employer must ensure that its employees, using portable ladders, are protected from falls and that no employee is allowed to use portable ladders with structural defects. New Homes Construction, Inc. was previously cited for a Serious violation of this Occupational Safety & Health Standard or its equivalent standard, 29 CFR 1926.1053(b)(16), which was contained in OSHA Inspection Number 1040582, Citation Number 1, Item Number 4 and was confirmed as a final order on 05/31/16, with respect to a workplace located at 12 Montclaire Road, Lot 19, Medford NJ. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
