29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly. The employer did not ensure the competent person conducted an initial exposure assessment prior to employees removing shingles containing 15% Chrysotile asbestos. The P-1 Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 315496877, citation number, 01 item number 002 and was affirmed as a final order on October 6, 2011, with respect to a workplace located at 124 E. 7th Street, Cincinnati, OH 45202.
