29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that: At the site; employees were not protected from cave-ins by adequate protective systems: a) On or about March 30, 2016; employees worked within a trench that was 7 feet 6 inches deep with no adequate protective systems, exposing employees to caught-in and engulfment hazards. b) On or about April 4, 2016; employees worked within a trench that was 6 feet 5 inches deep with no adequate protective systems, exposing employees to caught-in and engulfment hazards. 5758 CONSTRUCTION, LP WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 980353, CITATION NUMBER 1, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON 7/15/2014, WITH RESPECT TO A WORKPLACE LOCATED AT 810 MASON RD. #150.
